Terms & Conditions.
Please read the following terms and conditions carefully. You must not make any booking unless you understand and agree with the following terms and conditions. References to “us”, “we” and/or “our” in these booking terms and conditions shall mean Avion Retreat.
These terms and conditions apply to all bookings you make with us.
We will rely on the authority of the person making the booking to act on behalf of any other traveller on the booking and that person will bind all such travellers to these terms and conditions.
Guarantee Policy
At the time of booking, we require full payment of the total package amount to secure the booking.
If you book through a third party such as www.booking.com you will be agreeing to their terms and conditions in addition to our own. Please ensure that you have read and understood those third party conditions before booking your stay.
The following fees apply for credit card payments:
- 2% Visa Debit or Credit and Mastercard Debit or Credit,
- 3% for American Express
Cancellation Policy
Subject to your refund and remedy rights under the Australian Consumer Law, the following change and cancellations fees apply to our standard rate packages and bookings. Please refer back to your confirmation received at the time of booking as special packages and rates will be marked as non-refundable in which the below does not apply.
Bookings are transferable within a 12-month period, providing that the alteration is made more than 14 days prior to arrival date. No alterations can be made less than 14 days prior to arrival date.
All cancellations must be received in writing. Please email enquiries@avionretreat.com.au
For bookings cancelled more than 14 days prior to arrival and where the booking hasn’t been transferred – the total package amount paid will be refunded to the original method of payment less an administration fee of $90.
Cancellation within 14 days of arrival, the total package amount paid are forfeited.
No shows –the total package amount paid are forfeited.
Travel Insurance
We strongly recommend that you take out appropriate travel insurance to cover your travel arrangements. Your insurance protection should include cover for cancellation due to illness, medical and repatriation expenses, personal injury and accident, death and loss of personal baggage and money and personal liability insurance.
Health
You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel.
Refunds
Where applicable, refunds will be processed back to your original method of payment. Please note that credit card fees are non-refundable.
Prices
All prices are subject to availability and can be withdrawn or varied without notice. The prices quoted over the phone, via chat by email or in-person are subject to change thereafter. Availability can change at any time.
To proceed with your reservation and secure your booking we require full payment.
Liability
To the extent permitted by law, neither Avion Retreat nor any of its related bodies corporate, directors, employees or agents accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part. Under circumstances where our liability cannot be excluded and where liability may be lawfully limited, such liability is limited to the remedies required of us under applicable law (including the Australian Consumer Law). This liability clause is subject to your rights under the Australian Consumer Law and nothing in these terms and conditions is intended to limit any rights you may have under the Competition and Consumer Act 2010 (Cth).
Governing Law
If any dispute arises between you and us, the laws of Australia will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of Australia, and waive any right that you may have to object to an action being brought in those courts.
Acknowledgement
You acknowledge that you are 18 years of age or older and that you understand and agree with the above Booking Terms and Conditions and our Privacy Policy.
Privacy Policy
We are committed to protecting your personal information and agree to handle your personal information in accordance with our Privacy Policy. information to us, you agree that our Privacy Policy will apply to how we handle your personal information and you consent to us collecting, using and disclosing your personal information as detailed in our Privacy Policy. In particular, you agree that in certain circumstances (such as where you request us to book an experience for you), we are permitted to disclose your personal information to external recipients. Such recipients may include the travel service providers (e.g. tour providers) with whom you make a booking. Generally, we will only disclose your personal information to these persons in connection with facilitation of your travel booking and/or to enable the performance of administrative and technical services by them on our behalf. Where we disclose your personal information to any person, you agree that we will not be required to ensure that person’s compliance with Australian privacy laws or otherwise be accountable for how they handle your personal information. When used above, “disclose” includes to transfer, share, send, or otherwise make available or accessible to another person or entity.

If you access our web site, we may collect additional personal information about you in the form of your IP (Internet Protocol) address and domain name.
Also, our web site uses cookies. The main purpose of cookies is to identify users and to prepare customised web pages for them. Cookies do not identify you personally, but they may link back to a database record about you. We use cookies to monitor usage of our web site and to create a personal record of when you visit our web site and what pages you view so that we may serve you more effectively.
Use and disclosure
We only use and disclose personal information about you for the purposes for which it was collected (as set out above). Although, we may disclose personal information about you to:
Service providers, who assist us in operating our business, where you have requested an additional service to be provided for example transfers;
Other service providers, who provide the various services that you have requested and we have arranged.
A purchaser of the assets and operations of our business, providing those assets and operations are purchased as a going concern; and
Security and storage
The security of your personal information is important to us. We take all reasonable measures to ensure that your personal information is stored safely to protect it from misuse, loss, unauthorised access, modification or disclosure, including electronic and physical security measures.
The data that we collect from you may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”), primarily at the physical address of Avion Retreat, which is located in Australia. It may also be processed by staff operating outside the EEA who work for us or for one of our suppliers. Staff may be engaged in providing the services you have such requested such as accommodation or support services such as making a reservation. By submitting your personal data, you agree to this transfer, storing or processing. We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with the Privacy Act.
Access and your rights
You may access the personal information we hold about you, upon making a written request and providing proof of identify. You can also request for your information to be erased should it no longer be required to fulfill the service requested.
If, upon receiving access to your personal information or at any other time, you believe the personal information we hold about you is inaccurate, incomplete or out of date, please notify us immediately. We will take reasonable steps to correct the information so that it is accurate, complete and up to date.
Consent and marketing
Customers must provide expressed consent to receive email marketing. You can subscribe via our website and unsubscribe via the unsubscribe link found on each marketing email or you can call us to request removal.

Our website may contain links to other websites. We are not responsible for the privacy practices of linked websites and so linked websites are not subject to our privacy policies and procedures.
